ANTT carries a study to increase demand to reactive railway transportation on the western of São Paulo. The proposal was presented during a meeting carried on Wednesday (2), at Presidente Prudente. Luís Roberto Gomes, the Attorney General and entrepreneurs interested in reactivating the service attended the event.
Gilson Matos, ANTT’s railway transportation services monitoring coordinator, stated during the meeting that until now there is no formal protocol of complain, on behalf of s, regarding interruptions of the region service, but that the agency is investigating and will seek a solution for the problem.
“From the Public Prosecutor initiative, the idea is to objectively acknowledge these s, who claim not to have the railway transportation service, to investigate the problem and give technical treatment to this situation, so railway transportation can be enabled. It would be great for the concessionaire and s to get to an agreement, but, in case such thing fails to happen, the may request ANTT’s guardianship, or even in negotiating, so that the transportation can be possible.”
ANTT is available to listen to all s and to clarify all doubts that may arise along the whole process. “It is very important that, besides this long term s have been making to the Public Prosecutor, they use the technical expertise the agency has to clarify their doubts and to give necessary information to enable railway transportation.”
According to Luís Roberto Gomes, the Attorney General, the lack of railway transportation causes a great economic loss to the region, companies, society as a whole and to the environment, not only to the western of São Paulo, but throughout the State.
“Since 2001, the Public Prosecutor is struggling alongside civil society entities to re-establish railway transportation in the region. The concessionaire signed a Conduct Adjustment Contract (TAC) and has not fulfilled, later g a legal agreement that also did not fulfilled, claiming there is no demand. So, this is the matter we have been debating along the years, together with ANTT.” said Luís Roberto Gomes.
According to Gomes, the Public Prosecutor (MPF) has already entered an execution measure of the legal agreement and is charging the concessionary a fine of more than BRL 40 million. “The matter in sub judice, but, parallel to this, we are working alongside ANTT so the agency will perform its obligations and commands the concessionary to offer the railway transportation service to the region.”
According to Marco Antônio Goulart, lawyer of Uepp (Union of entities of Presidente Prudente and Regions), they expect the railway transportation to run as soon as possible.
“This is a mile stone for our region and will be extremely important, since we managed to prove that there is demand for the railway freight transportation in our region. Uepp is positive and expects the service to run again.”
Next steps
According to Matos, from now on ANTT will directly every so the agency can act in a concrete case based on origin and destination data and, in case the lack of service continuous, to act ensuring a debate with the concessionary regarding the problem.
“It was ANTT’s choice not to call the concessionary to discuss the matter. It is obvious that the concessionary will be called for the discussion, as soon as the demand is consolidated and after ’s agreement.”
The other side
Through a statement, América Latina Logística (ALL) told G1 that was not officially notified about the meeting held on Wednesday (2), at Centro Cultural Matarazzo in Presidente Prudente, but clarified that “the concessionaire has carried out studies on the economic viability of the section and held several meetings with the entire region businesses in order to clarify questions about the provision of services and the operation of the railway, as peculiarities of railway services, technical data, operational parameters, pricing policies, among other points, to make possible the resumption of railway transportation in the section”
